BEFORE HONOURABLE MR. JUSTICE N. UNNI KRISHNAN NAIR ORDER Date : 08-09-2025 Heard Ms. N. Anju, learned counsel for the applicant. The present Interlocutory Application has been filed by the District Election Officer, Seppa, East Kameng District with the following prayer:- “In the premises stated above, it is humbly prayed that the Hon’ble Court would be pleased to pass an order allowing the applicant to shirt all electronic materials viz., the EVMs/ VVPATs of 11-Seppa West (ST) Assembly Constituency, which are stored at Government Higher Secondary School, Bebo Colony, Seppa to the Strong Room/ Warehouse of the office of District Election Officer, Seppa, East Kameng District.” I have perused the contention raised in the Interlocutory Application, as well as heard the learned counsel for the parties. On consideration of the matter, this Court finds that the shifting of the election materials, including EVMS, VVPATs of 11-Seppa West (ST) Assembly Constituency, which is presently stored in the Government Higher Secondary School, Bebo Colony, Seppa, is being sought for with a view to free the said School for educational activities. The said materials is now undertaken to be stored in a Strong Room of the District Election Officer. The learned counsel for the petitioner, as well as the respondent, has submitted that they would have no objection, in such shifting of the election materials provided that Page No.# 3/3 the same is so made in the presence of the election petitioner and the returned candidate and/ or their authorised representatives. In view of the consensus arrived at in the matter, the District Election Officer, Seppa, is permitted to shit the election materials, as noticed hereinabove, from the Government Higher Secondary School, Bebo Colony, Seppa and to store them in the Strong Room, District Election Officer, Seppa, East Kameng District, by maintaining all required due protocols. Such shifting be done after issuance of notice scheduling date for the same, to the petitioner and the returned candidate and the shifting be carried out on the date so fixed, in presence of the election petitioner and the returned candidate and/ or their duly authorised representatives.
