2 2025:HHC:28739 petitioner is unemployed and she has no means of earning any livelihood. She has a four years old son and presently, the petitioner and her son are at the mercy of her father and they are residing with her parents at Bilaspur. He further submitted that even the father of the petitioner is a daily wager and in these circumstances, it is extremely difficult for her to travel to Shimla and defend herself in the said proceedings at Shimla. Accordingly, he prayed that in the peculiar circumstances, the case be ordered to be transferred to Bilaspur.

In the light of the fact that it could not be demonstrated by the respondent that the petitioner is not unemployed, she is not residing with her minor with her father at Bilaspur and it is not difficult for the petitioner to defend herself in the said proceedings at Shimla, this petition is allowed. The proceedings filed by the respondent against the petitioner i.e. HMA No. 274 of 2024, titled Mahesh Kumar Vs. Shivani, which are presently pending before the learned Principal Judge, Family Court, Shimla, are ordered to be transferred to the Court of learned Additional Principal Judge, Family Court, Ghumarwin, District Bilaspur, H.P (Camp at

4. The petition stands disposed of accordingly. Pending miscellaneous application(s), if any, also stand
disposed of.
