The petitioner is before this Court seeking for the following reliefs: “WHEREFORE, the petitioner prays before this Hon’ble Court that this Hon’ble Court may be pleased to quash the FIR in Crime No.25/2025 register by respondent No.1 Soladevanhalli Police Station for the offences punishable under Section 316(2), 318(2) of BNS, 2023 pending on the file chief judicial magistrate, Bengaluru Rural District Bengaluru, in the interest of justice and equity.” 2. Proceedings in Crime No.25/2025 had been registered against the petitioner on a complaint filed by respondent No.2 for the offences punishable under Section 316(2), - 3 - HC-KAR NC: 2025:KHC:18441 CRL.P No. 7563 of 2025 318(2) of BNS, 2023 on the allegations that the petitioner had made false promises of marriage to respondent No.2. 3. The dispute between the parties have been stayed and the application under Section 359(1) read with Section 528 of BNSS, 2023 has been filed. 4. The joint affidavit reads as under: We, 1. The averments made in the accompanying application from paras 1 to 3 for settlement and to quash the proceedings are true and correct to the best of our knowledge, information and belief. 3. Both of us Petitioner and respondent No.2 have settled the dispute and we have decided to put an end to the investigation in FIR in Crime No. 25/2025 register by respondent No.1 Soladevanahalli Police Station for the offence punishable under section 316(2), 318(2) of BNS, 2023 pending on the file chief judicial magistrate, Bengaluru Rural district Bengaluru, and the respondent No.2 has undertaken to withdraw the cases pending against the petitioner and the petitioner undertakes to not file any civil and criminal defamation case against the respondent no.2 relating to the Crime no.25/2025. we - 4 - HC-KAR NC: 2025:KHC:18441 CRL.P No. 7563 of 2025 have entered into compromise voluntarily and out of free will for the purpose of maintaining good relationship 4. Respondent No.2 is personally present before the Court. 6. On enquiry, she submits that dispute between the petitioner and respondent No.2 has been voluntarily settled between the parties without undue influence, coercion or the like. 7. She further submits that she does not wish to prosecute the petitioner in the opposite Crime No.25/2025. 8. Placing her submission on record, I pass the following: ORDER i. Criminal Petition is allowed. ii.
