IA No.: CAN 2 of 2024 preferred under Section 5 of the Limitation Act pending till date is taken up for hearing. By the instant application, the petitioner has prayed for condonation of delay in filing the application for recalling. It is the contention of the petitioner that the petitioner was not aware of the order of the court and as such in the interest of justice, he has prayed for said condonation of delay. Considering the grounds as made out and in the interest of justice the application for condonation of delay is allowed on the delay being condoned. The order of dismissal dated 06.09.2022 is recalled. Writ Petition No.9936 of 2016 is restored to its original file and number. IA No.: CAN 1 of 2024 stands disposed of. By the said writ application, the petitioner herein has prayed for direction upon the respondent Bank to consider the petitioner’s representation dated
12.04.2016. It is submitted by the writ petitioner that all he seeks is now consideration of his representation dated 12.04.2016 in accordance with law. On hearing the learned counsel appearing for the parties and considering the relief as prayed for the writ petition is disposed of with the direction that the respondent Bank shall consider the representation dated 12.04.2016 of the petitioner
3 who shall file a copy of the same before the respondent Bank in case, the original is not traceable.
The petitioner shall file the same within seven days from the date of communication of this order and the respondent Bank shall make all endeavour to dispose of the representation in accordance with law on hearing concerned parties within a period of sixty days thereafter. The writ petition stands disposed of. Urgent Xerox certified copies of this order, if applied for, shall be supplied to the learned counsel for the parties as expeditiously as possible, in compliance of usual formalities.
