1. The instant writ petition is being preferred by the petitioner with a limited prayer that the petitioner is in possession over 6 dismil of land bearing khasra no. 1867 situated at Village Raghunathpur, Tehsil Lundra District Sarguja (C.G.) by constructing a house and cultivating it since
2 46 years and has made application before respondent no. 2 for granting patta recently on 27.05.2025 and several times earlier also but the respondent authorities have not taken any steps in deciding the application for grant of patta of the petitioner. 2. Learned counsel for the petitioner submits that the in action for not considering the application/representation of the petitioner for grant of patta by the respondent authority is arbitrary in nature and also contrary to law. The respondent no. 2 can very well decide the application of the petitioner under provision of Revenue Book Circular under which the provision of allotment of revenue land has been dealt with in Chapter 4 Rule 3 and the rules have already been framed in CG Land Revenue Code and Revenue Book Circulars for allotment of the patta and bhumiswami rights. 3. Learned State counsel disputed the allegations made by the petitioner and further raised no objection in issuing direction to the Collector to decide the application of the petitioner in accordance with law/rule/regulation. 4. I have heard learned counsel for the respective parties and perused the record with utmost circumspection. 5. The petitioner has filed the present petition with a limited prayer of issuing direction to the respondent authorities to consider and decide the application dated 27.05.2025 filed by the petitioner for grant of patta of land bearing Khasra No. 1867 Rakba 6 dismil situated at Village Raghunathpur, Tehsil Lundra District Surguja (C.G.) within some stipulated time. 3

The present writ petition stands disposed of with a direction to the respondents to consider and decide the application dated 27.05.2025 filed by the petitioner as per law/rules/regulations. SD/-
