2. This application under Section 483 of BNSS, 2023 has been filed by the accused/petitioner, namely, Almamun Hussain Pramanik, praying for grant of bail in connection with North Guwahati P.S. Case No.111/2025 under Sections 331(3)/305 of the BNS, 2023. The accused/petitioner was arrested on
04.12.2025. 3. The FIR was lodged by one Kanika Kalita on 04.12.2025. The allegation was that there was a theft/robbery in her rented house, where upon, cash mobile and jewellery, ATM cards were taken. The present accused was arrested during investigation and the grounds of arrest indicate that he was involved and in contact with one Abdul Kudus, who is the receiver of stolen items and that the said Abdul Kudus fled in the presence of the police. 4. The case diary has been received. 5. The learned Addl. P.P. clearly submits that the investigation so far has revealed that the present petitioner is a friend of the said Abdul Kudus and there is allegation that one person gave some stolen items to Abdul Kudus in his presence but the Abdul Kudus fled away with regard to the theft in the house of the informant. There is stated to be no direct materials so far regarding the involvement of the present petitioner. 6. The learned petitioner counsel has drawn my attention to the arrest memo and submitted that though it bears the signature of the arrestee but it does not bear signatures of the any witness. 7. I have perused the arrest memo and I find force in the contention of the petitioner counsel and also considered the fair submission of the learned Addl. P.P.

In the given facts and circumstances, the accused/petitioner is hereby
Page No.# 3/3 allowed to go on bail of Rs. 40,000/- with one surety of like amount to the satisfaction of the learned concerned Court and subject to the following conditions that:- (i) That the accused person shall not abscond, (ii) That the accused person shall not hamper or tamper with evidence, (iii) That the accused person shall co-operate with the investigation, (iv) That the accused person shall not indulge in any illegal activities or offences. 9. Violation of any bail conditions will entail cancellation of the bail. 10. This bail application stands allowed and disposed of. 11. Send back the case diary. JUDGE Comparing Assistant
