THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION No.214 OF 2025 ORDER:
This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A1, seeking bail, in Crime No.198/2024 of Gunadala Police Station, Vijayawada city.
2. A case has been registered against the petitioner and others for the offences under Sections 376(2)(n), 498-A IPC and 6 of the POCSO Act and 9 and 13 of the Child Marriage Act,.3 and 4 of the D.P.Act.
3. Case of the prosecution is that A1 developed acquaintance with the victim girl aged about 16 years. On 29.6.2024, A1 on the pretext of love, with his deceitful words, took her to Machilipatnam bus stand and from there to Gudivada along with him and later took her to his house at Ramannamudi village and had sexual intercourse with her. On 30.6.2024, A1’s sister in law informed the victim girl that A1 was already married. Then A1 informed to the victim that his wife left him and he had two children. Later A1 brought the victim to the house of A2 who is his sister and there they both worked in a private laundry and due to floods they left that job and later in the month of October, 2024, A1 started working as welder. Then both A1 and A2 used to harass the victim

physically and mentally and unable to bear the torture she went to Gundala police station and reported the matter to police.
4. Heard. Perused the record.
5. Learned Assistant Public Prosecutor submits that investigation is not yet completed and some more witnesses have to be examined.
6. A perusal of the material available on record goes to show that there are grave allegations against the petitioner/A1. The victim was aged about 16 years i.e. she was a minor, by the date of the incident, and that A1 was already married and he had two children and the wife of A1 left him. A1 was arrested on 24.11.2024. As investigation is at nascent stage, this Court is not inclined to grant bail to the petitioner/A1, at this stage.
7. Accordingly, the Criminal Petition is dismissed.
