Also heard Mr. D.P. Goswami, learned Additional PP for the State. This application has been filed filed under Section 483 of the BNSS, 2023 seeking bail of the petitioner, namely, Deep Roy, who was arrested on 28.09.2025 in connection with Page No.# 2/2 Dispur PS Case No. 639/2025 under Section 316(2)/318(4) of BNS, 2023. Earlier, bail application being Bail Appl. No. 3431/2025 was filed on behalf of the present petitioner and was rejected by an Order dated 14.11.2025. Upon perusing the Case Diary, there is sufficient material against the petitioner. Learned counsel for the petitioner submits that the petitioner has completed 59 days in custody and therefore, he is on the verge of completing the detention period and therefore his further detention would not be necessary. Considering the above, the prayer for bail is allowed. Accordingly, the petitioner named above shall be released on bail on furnishing a bond of Rs. 50,000/- with two sureties of the like amount to the satisfaction of the Elaka Magistrate in connection with the aforementioned case. It is further provided that the petitioner shall co-operate with the investigation and shall not try to influence the witnesses or tamper with the evidence. It is also provided that the petitioner shall not leave the District without prior permission of the learned Elaka Magistrate. The Bail Application stands disposed of. JUDGE Comparing Assistant
