Accordingly, they are being disposed of by a common order. Heard the parties. 2. Petitioners have been made accused in connection with S.T. Case No. 261 of 2023 arising out of Khunti P.S. Case No. 126 of 2023 corresponding to G.R. No. 619 of 2023 for the offences registered under sections 302/323/34 of the Indian Penal Code and section 27 of Arms Act, pending in the court of learned District and Additional Sessions Judge-II, Khunti. 3. Bail application of the petitioner Kishan Mundu was earlier rejected by this court vide B.A. No. 2049 of 2024 by order dated 19.04.2024. 4. On 06.09.2023, father of the Informant was shot dead while he was sleeping in his house. Informant saw the petitioners fleeing away from the place of occurrence. It appears that on the basis of confessional statement of the petitioners, firearm which was used in the commission of murder of the deceased, was recovered. 5. It was submitted that the Informant has been examined and he has not supported the prosecution case and he has been declared hostile. It was further submitted that co-accused has been granted bail by a coordinate Bench of this Court. 2. 6. Considering the nature of allegation and the fact that the trial is under progress, I am not inclined to enlarge the petitioners on bail. Accordingly, their prayer for bail stands rejected.
