This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 48/2024 registered at Police Station Antagrh, District North Baster Kanker (C.G.), for the offences punishable under Sections 90(1), 91, 238, 3(5), 103(1) of the
2 BNS, 2023.

The prosecution's story, in brief, is that the applicant has given birth control tablets to the victim who was the love interest of the main accused Nagesh Kumar Komra which was given from the medical store registered in the name of the daughter of the present applicant and examined victim Amrita Padda and given five birth control tablets to the victim and the co- accused Nagesh Kumar Komra has given tablets to her in the house of her sister which resulted into the death of the victim. So on the basis of the report thana police registered the offences under the aforesaid offences and arrested the applicant for the alleged commission of the offence.

Learned counsel for the applicant submits that the present applicant is innocent person and has been falsely implicated in the aforesaid case. He submits that the applicant has only been arrested on the memorandum of the co accused and the present applicant is arrested only on the fact that the present applicant was the sister of the co acused and he has visited her place and given tablets tot he victim and there is no involvement of the present applicant on giving tablets or committing any other incident and there is no record available
3 that any involvement of her nothing has been seized from her and no material available on record which shows that she has committed crime. The trial is likely to take some considerable time to conclude, hence he prays for grant of bail to the present applicant.
4. On the other hand learned State counsel opposes the bail application of the present applicant. She contended that the present applicant has a major role to play in the crime in question. She is the only one who has given the said tablets to the victim.
5. I have heard learned counsel for the parties and perused the case diary with utmost circumspection.

Taking into consideration the facts and circumstances of the case, specially to the fact that it is an indisputable fact that the present applicant was the only one who has given the said tablets to the victim. Hence it cannot be said that there is no prima facie case made out against the present applicant. Therefore, looking to the seriousness of the crime and also the participation of the present applicant in the crime in question, this court is not inclined to allow the bail application
4 of the present applicant.
7. Accordingly, the present MCRC stands rejected.
