3. The learned publI-C Prosecutor submits that the investigation is not yet completed, as certain documents are required to be sent to the FSL, for which an application has been filed before the learned Trial Court, in which the Petitioner iS expected tO file his counter. Hence, the learned public Prosecutor opposed the Present aPPll-CatiOn On the ground that the investigation is still pending-
4. The learned counsel for the petitioner submits that the health condition of the petI-tiOner does not Permit him to appear before the Investigating officer twice a week, as the petI`tiOner requires surgery to his nose
5. ConsiderI|ng the facts and circumstances of the case, this court is of the view that balancing of equity is required to be maintained between the parties. lf the conditI-On iS SIightly relaxed by directing the petitioner to appear before the Investigating Officer once a week, i.e., on every saturday between 10:00 A.M. and 5.loo P.M., it would meet the ends of justice. Accordingly, the condI-lion I-mPOSed earlier is r.elaxed. The criminal petition is partly allowed, relaxing the condition and dI-reCting the petitioner to appear before the station House Officer once a week, i.e., on every saturday between 10:00 A.M. and 5:00 P.M., for a period of three months or until filing of the charge sheet, whichever is earlier.
