1. Mr. Pranav Singh, learned counsel for the applicant.
2. Mr. Sandeep Sharma, learned Brief Holder for the State.

Present applicant–Raees is seeking bail in relation to F.I.R No.0788 of 2024, wherein the present applicant has been implicated for the offences punishable under Section 109(1) of Bharatiya Nyaya Sanhita, 2023 read with Section 25(1)(b) of Bharatiya Nyaya Sanhita, 2023 at Police Station Kotwali Manglore, District Haridwar.

Learned counsel for the applicant submits that the applicant is innocent and has falsely been implicated. Apart from this, it is submitted that on the basis of this FIR, the applicant was implicated in another Case Crime No.775 of 2024 which pertains to the offences punishable under Section 127(2), 310(2) and 317(3) of the BNS Act.
5. He also submits that the applicant has no nexus with the other co-accused. Apart from this, he submits that the applicant has also been implicated under Section 2/3 of the Gangster Act only on the basis of the two cases i.e. the present one and the second one is Case Crime No. 775 of 2024.
6. Per Contra, learned State counsel submits that the applicant has criminal history with the same nature of case since he was also implicated in Case Crime No. 775 of 2024.
7. After hearing the arguments as advanced by learned counsel for the parties, and after perusing the FIR and after taking into
consideration that the applicant is also an accused in Case Crime No. 775 of 2024, which pertains to the offence punishable under
2025:UHC:1224 Section 127(2), 310(2) and 317(3) of BNS, 2023, this Court is of the view that the applicant does not deserve bail.
8. Accordingly, without expressing any opinion on the merit of the case, the bail application is rejected.
