[2025:RJ-JP:34699] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 10177/2025 Vikas @ Bitthu S/o Shri Ramchandra Gawariya, Aged About 18 Years, D.o.b.-07/01/2007, R/o Ward No. -1, Gawariyo Ka Mohalla Laxmangarh, Ps Laxmangarh, District-Sikar. (Presently Confined In Central Jail, Jaipur) ----Petitioner Versus State Of Rajasthan, Through P.P. ----Respondent For Petitioner(s) : Mr. Vijay Kumar Jangid For Respondent(s) : Mr. Manvendra Singh, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 29/08/2025 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 257/2025 registered at Police Station Chomu, District Jaipur (West) for the offences under Section 108 of BNS. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that prima-facie offence under Section 108 of BNS is not made out. The petitioner has not uploaded any photographs of the deceased on Instagram. The allegation that before committing suicide, deceased called the petitioner to remove the photographs on Instagram is also wrong. The petitioner is a young boy of 18 years, charge-sheet has already been submitted and the petitioner is in custody since 19.04.2025 and trial of the case may [2025:RJ-JP:34699] (2 of 2) [CRLMB-10177/2025] take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application. 4. Heard and perused the charge-sheet. 5. In the charge-sheet, it is specifically alleged against the petitioner that the deceased Suman called the petitioner to remove the photos uploaded on Instagram, however, the petitioner did not remove the photographs, the mobile phone in which the photos was found was recovered from the possession of the petitioner and the matter has been sent to FSL for retrieving the evidence. The allegations against the petitioner are grave, therefore, I am not inclined to enlarge the accused-petitioner on bail. 6. Hence, the present criminal misc. bail application of the accused-petitioner is hereby dismissed. (PRAVEER BHATNAGAR ), J Keshav/104
