Heard Mr. Ng. Somorjit, learned counsel for the petitioner and Mr. H. Devendra, learned Dy. AG on behalf of the State respondents. [2]
By the present petition, the petitioner who is an owner of lands under patta no. 273 (old)/ 107 (new) covered by C.S. Dag No. XVI/159 measuring an area of .0057 hectare of Village No. 87 (A) Khwai Bazar, Imphal West Tehsil. [3]
In pursuance of the public notice dated 31.07.2025 issued by D.C., Imphal West, the officials of the Revenue Department make a joint survey on 06.07.2025 and without any proper demarcation, the officials of Revenue Department marking on the structure within the patta land of the petitioner and the petitioner apprehend for illegal demolition and eviction. [4]
On the other hand, Mr. H. Devendra, learned Dy. AG submits that in the present mass eviction drive of encroachment upon the Govt. land, the Deputy Commissioners of different districts issued public notice for removal of structure from the Govt. land and marking made by the authority on the alleged encroached structure is a preliminary of demolition and eviction will be conducted only after proper verification. The petitioner also submitted objection in the Court of the SDO, Lamphel, Imphal West, Eviction Case No. 20 of 2025 by explaining her case and objection is still pending with the authority. [6]
This Court is of the opinion that the present writ petition can be
disposed of at this stage by directing the respondents to give an opportunity of being heard to the petitioner to ascertain the land encroached upon the Govt. land by the petitioner and any eviction can be done only after proper verification. [7]
The encroachment of structure by the petitioner within her patta land is protected. [8]
With these observations, the present W.P. (C) No. 790 of 2025 is
disposed of.
