HON'BLE MR. JUSTICE NARENDRA SINGH DHADDHA
Order 06/01/2025 By way of this petition, the petitioner-plaintiff (for short ‘the plaintiff’) has challenged the order dated 15.07.2024 passed by the Additional District Sikrai, District Dausa (for short ‘the appellate court’), whereby the appellate court while dismissing the appeal filed by the plaintiff, affirmed the order dated 19.08.2023 passed by the Civil Judge, Sikrai, District Dausa (for short ‘the trial court’), by which the trial court dismissed the T.I. application filed by the plaintiff.
Learned counsel for the plaintiff submits that during the pendency of the suit, the respondent-defendant No.1 had taken electricity connection over the plot.
(2 of 2) [CW-14157/2024] Taking into consideration the facts and circumstances of the present case and more particularly in view of the fact that the suit was filed before the trial court in the year 2023, thereafter one year has been passed, instead of interfering with the impugned orders, I dispose of the present civil writ petition with a direction that the trial court while adjudicating the suit filed by the plaintiff shall not be influenced by the finding recorded by it in T. I. application and the finding recorded by the appellate court in appeal, regarding gift deed. Pending application(s), if any, also stand(s), disposed of.
