THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA CONTEMPT CASE NO: 4963/2023
ORDER: Heard the learned counsel for the petitioners and the learned counsel for the respondents.
2. Learned counsel for the petitioner submits that the respondent have not complied with the orders dated 01.04.2022 passed by this Court in W.P.No.7889 of 2022, which is extracted hereunder:
“Having considered the submissions made by the
learned counsel for the petitioners and learned Government Pleader for Irrigation, keeping in view the welfare of the petitioners as well as the ayacutdars, who are drawing water from the project for irrigation purpose, shall be of paramount importance and in the facts and circumstances of the case, the respondents are directed to monitor the water level at the project as per the decision of the experts, uninfluenced by any of the local public representatives, without causing any inundation of the lands of the petitioners. As alleged by the learned Government Pleader for Irrigation, if the lands of the petitioners are at full tank level, it should be notified that what extent of land being cultivated by the petitioners is situated at full tank level, after conducting joint survey with the revenue authorities. The petitioners are permitted to submit a detailed representation along with the relevant documents showing their absolute rights, to the respondent authorities seeking for conducting of joint survey with the revenue authorities and for

earmarking of their lands. After conducting the joint survey, if it is found that the petitioners’ lands are put to inundation, the respondent authorities shall take steps for acquisition of their lands as per law. The Writ Petition is accordingly disposed of. There shall be no
order as to costs.”
3. Learned counsel for the respondents submits that in compliance of the orders of this Court, the respondents conducted joint survey on 13.08.2024 and submitted a report. It is enumerated at the survey report that some of the lands are inundated. Therefore, the orders of this Court are complied with.
4. Upon hearing, both the learned counsel and on perusal of the report submitted by the learned counsel for the respondents, the Contempt Case is closed, granting liberty to the petitioner to proceed further in accordance with law. No order as to costs. Consequently, Miscellaneous Petitions, if any, pending in the contempt case shall stand closed. ________________________________ VENKATESWARLU NIMMAGADDA, J
