ORAL ORDER
Accused No.2 in Crime No.81/2025 registered by Rajagopalanagara Police Station, Bengaluru City, for the offences punishable under Sections 109, 115(2), 126(2), 3(5), 351(2), 351(3), 352, 118(2) OF BNS 2023, is before this Court under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail.
2. Heard the learned counsel for the parties.

F.I.R. in Crime No.81/2025 was registered by Rajagopalanagara Police Station, Bengaluru City, against Pramod and the petitioner herein who is the father of accused No.1-Pramod for the aforesaid offences on the basis of first information dated 07.03.2025 received from Sri.Steven J, who is one of the victims in the present case.

During the course of investigation of the case, the petitioner herein, who is arraigned as accused No.2 in the FIR was arrested on 07.03.2025 and subsequently remanded to judicial custody. After completion of investigation charge sheet has been filed against two persons. Petitioner is arraigned as accused No.2 in the charge sheet. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.2291/2025 was rejected on 04.04.2025. Therefore, he is before this Court.

Learned counsel for the petitioner submits that accused No.1 as against whom there is an allegation of assaulting with a weapon, has already been enlarged on bail in Crl.P.No.5817/2025. Petitioner herein who is the father of accused No.1 is in custody from 07.03.2025. Accordingly, he prays to allow the petition.

5. Per contra, learned HCGP has opposed the bail petition. She submits that the petitioner is a person with criminal antecedents. Accordingly, she prays to dismiss the petition.

Perusal of the material available on record would go to show that in respect of the alleged incident that had taken placed on 06.03.2025 at about 7.30 p.m., there is a case and counter case registered by Rajagopalanagar Police Station, Bengaluru in Crime No.81/2025 and Crime No.82/2025. The accused Nos.1 and 2 in Crime No.81/2025 were arrested on 07.03.2025. Accused No.1 has been granted regular bail by this Court in Crl.P.No.5817/2025,
disposed of on
28.04.2025. Investigation of the case is completed and charge sheet has been filed thereafter. Allegation of assault in the incident with weapon and causing grievous injury is found as against accused No.1 in the charge sheet. Incident in question was the outcome of road rage between two

parties. Since the petitioner has made out a case for grant of regular bail merely for the reason that he has some criminal antecedents, his prayer for grant of regular bail cannot be rejected.
7. Accordingly, the following:
ORDER The Criminal Petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.81/2025 registered by Rajagopalanagar Police Station, Bengaluru City, for the offences punishable under Sections 109, 115(2), 126(2), 3(5), 351(2), 351(3), 352, 118(2) OF BNS 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;

c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future;
