BEFORE HONOURABLE MR. JUSTICE SOUMITRA SAIKIA ORDER 15.12.2025 Heard M.S Ali, learned counsel for the applicant. The learned counsel for the applicant submits that the sole respondent arrayed in Cont. Cas(C) No. 167/2022, namely Shri Jayant Narlikar, has since demitted his office as Commissioner, Lower Assam Division, Pan Bazaar, Guwahati. The learned counsel for the applicant/contempt petitioner submits that the opposite party in the interlocutory application is presently the Commissioner, Lower Assam Division and therefore since the directions contained in the order dated 26.03.2021 passed in W.P(C) No. 2232/2021 has not been complied with, the opposite party/ respondent is a necessary party to be arrayed as a party respondent in the contempt petition. None represents the respondent in the contempt petition.
Page No.# 3/3 Considering the submissions made by the applicant, Dr. Om Prakash, the Director of Assam Land Records and Survey, Assam, Rupnagar, Guwahati-32 is arrayed as opposite party No. 2 and is stated to be presently the Commissioner, Lower Assam Division who was directed to comply with the directions contained in the order dated 26.03.2021 passed in W.P(C) No. 2232/2021 is considered to be necessary party and thereby arrayed as a party respondent in the contempt petition. Accordingly, interlocutory application stands allowed and disposed of. The applicant will file amended cause title in terms of the present order before the Registry within two weeks from today.
