This is the second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.07/2025 registered at Police Station, Pithora, District Mahasamund, (C.G.) for the offence punishable under Sections 318(4), 319(2) of B.N.S. 2023. 2. Case of the prosecution, in brief, is that on 15.01.2025, the complainant Aditya Kumar Dubey made complaint to the police of police station Pithora, District Mahasamund (C.G.) Stating that on 25-12-2024 he received a phone call from one person, who address herself as Geetanjali and claims to be the friend of his Niece i.e. Lakshmila Sen. It has been informed to the complainant that her father has met with an accident and required money for medical treatment. based on this false information, they received a total of Rs. 7,27,000/- from the complainant between 25-12- 2024 to 12-01-2025 through PhonePe on different bank accounts using the mobile numbers 9174757898 and 7224062230, thereafter F.I.R. was registered for offence punishable U/s 318(4), 319(2) B.N.S. 2023 and present applicant was arrested on 15-01-

Learned counsel for the applicant submits that this is the second bail application of the applicant and the first bail application of the applicant was rejected on 04/04/2025 vide MCRC No.2681/2025. She would submit that the co-accused person namely Santoshi Netam has been granted regular bail by this Court on 22/04/2025 in MCRC No.3034/2024, applicant is in jail since 15/01/2025, hence the applicant be enlarged on bail. 4. From perusal of the records, it transpires that this is the second bail application of the applicant and the first bail application of the applicant was rejected on 04/04/2025 vide MCRC No.2681/2025. It transpires from the order dated 22/04/2025 passed in MCRC No.3034/2025 that Santoshi Netam D/o Ramayan Singh was granted bail only on account of the fact that she facilitated in the crime in question and no recovery of any money was made from the said co-accused whereas the applicant received money from the complainant through PhonePe as it is reflected from the order rejecting first bail of the applicant, therefore I am not inclined to entertain this second bail application. 7.
