Neutral Citation No. - 2025:AHC:36708-DB Chief Justice's Court Case :- SPECIAL APPEAL No. - 495 of 2018 Appellant :- C/M Sri Kasi Annapurna Vasavi Arya Vysya Vrudhashramam and Nityanna Satram and another Respondent :- State of U.P. and 4 others Counsel for Appellant :- Girish Kumar Gupta Counsel for Respondent :- C.S.C., H.N. Singh (Sr. Adv.) with Abhishek Dwivedi, Ankit Gaur (S.C.), Chandan Sharma, Kartikeya Saran, Vineet Kumar Singh Hon'ble Arun Bhansali,Chief Justice Hon'ble Kshitij Shailendra,J.
1. An application has been filed by the respondent No. 4, inter alia, indicating that the appeal has been filed questioning the validity of order dated 20.04.2018 passed by learned Single Judge dismissing modification application filed by the appellants.
2. The petitioners, in the writ petition, had challenged the order dated 07.09.2016, whereby election of the Committee of Management of the Society was directed to be conducted under Section 25(2) of the Societies Registration Act, 1860 (for short 'the Act'). Learned Single Judge, by order dated 02.08.2017, disposed of the writ petition with the observation that the order passed by the Registrar was modified to the extent that the fresh elections under Section 25(2) of the Act would be conducted after inviting objections to the electoral collage.
3. The modification application was filed seeking a direction that till such time that the elections are held, the existing body may be permitted to continue and the status quo be ordered to be maintained. The said application came to be rejected against which the present special appeal was filed, no interim order was granted
in the present appeal.
4. Now, it is indicated that elections of the Committee of Management have been held on 01.09.2024 and the new elected Committee has been registered and a renewal certificate for a period of five years in relation to the Society has been issued and therefore, the appeal has been rendered infructuous.
5. Learned counsel for the appellant, though is not in a position to dispute the submissions made in the application, submits that he has no instructions in the matter.
6. In view of what has been indicated in the application, supported by affidavit, the appeal is dismissed as having become infructuous. Order Date :- 12.3.2025 Mukesh Pal/Pkb (Kshitij Shailendra, J) (Arun Bhansali, CJ) Digitally signed by :- MUKESH PAL High Court of Judicature at Allahabad
