JUSTICE A. GUNESHWAR SHARMA O R D E R 24-09-2025 [1] Present Mr. Playson Anal, learned counsel assisted by Mr. Moses Pao, learned counsel for the petitioner and Mr. L. Shashibhushan, learned senior counsel assisted by Ms. L. Liya, learned counsel for the IOC. [2] The main prayer in the writ petition is for giving some time to the petitioner for reconstitution of the agency and for payment of penalty amount. The petitioner has submitted a representation in this regard to the IOC and the same is still pending. [3] Today, during the course of hearing, Mr. L. Shashibhushan, learned senior counsel for the IOC, on instructions, submits that the petitioner may be given one year’s time for payment of the penalty amount imposed upon the petitioner provided the same is paid in monthly or quarterly or half yearly instalments. [4] However, Mr. Playson Anal, learned counsel for the petitioner, has WP(C) No. 722 of 2025 & MC(WP(C)) No. 673 of 2025 suggested that the petitioner may be allowed to make 50% payment within six months and the remaining 50% on or before the end of one year. [5] In view of the above submissions, the writ petition is disposed of by extending the time for payment for one year. However, it is open to the petitioner to pay monthly or quarterly or half yearly provided there should be no default in the payment. It is also made clear that notwithstanding anything in this order, the respondents may consider sympathetically the pending representation submitted by the petitioner for reduction of the penalty amount. [6] With this observation, the writ petition is disposed of. This order is passed in the peculiar facts and circumstances of the present case specially when the earlier owner expired recently and shall not be pleaded as a precedent in future. [7] It is made clear that this Court does not express any opinion on the merit of the case. [8] MC(WP(C)) No. 673 of 2025 is also disposed of.
