Ms. Priya Sahay, Advocate For the State : Ms. S. Aind, APP ----- 04/ 17.06.2025 Heard the parties. 2. This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 302/34 of the Indian Penal Code pending in the court of JMFC, Giridih in connection with Protest- cum-Complaint Case No. 620 of 2023. 3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 4. Admittedly after investigation final report was submitted in favour of the petitioner exonerating him from the offences. The informant thereafter filed protest petition which was converted into complaint. On the basis of the said complaint cognizance has been taken by the Court and thereafter the petitioner has been summoned. 5. Since in this case cognizance has already been taken, the petitioner should appear before the concerned court as there is no scope of arrest of the petitioner and also there is no scope of investigation. 2025:JHHC:15796 2 6. The court concerned will pass an appropriate order considering that cognizance in this case has already been taken and there is no scope of investigation. 7. Accordingly, this Anticipatory Bail Application stands disposed of. (ANANDA SEN, J.) Tanuj/Cp-3
