In this petition, the petitioners seek the following reliefs:
"a. Quash the entire proceedings in C.C.No.27904/2018 (PCR No.3194/2017)-(Crime No.84/2017), registered by the 1st Respondent- Basaveshwaranagara Police Station, Basaveshwaranagara, for the alleged offences, under Section U/s.415, 416, 419, 420, 463, 465, 468, 471, 201, 120(b) of IPC registered on the complaint of the 2nd Respondent, pending on the file of the special Court for economic offences, Bengaluru.
b. Pass any other order or orders, which this Hon'ble Court deems it just and necessary in
facts and circumstances of the present case, in the interest of Justice and equity."
2. Heard learned counsel for the petitioner and learned counsel for respondent No.2 and perused the material on record.
3. A perusal of the material on record will indicate that petitioner No.1/accused No.1 and petitioner No.2/accused No.3 are the brother and mother, respectively, of respondent No.2-

HC-KAR NC: 2025:KHC:22085 CRL.P No. 7466 of 2025 complainant, who filed the complaint in PCR No.3194/2017, which was referred to the jurisdictional police authorities for investigation and registered as an FIR in Crime No.84/2017 pursuant to which, C.C.No.27904/2018 is pending before the trial Court. Meanwhile, the civil dispute in O.S.No.234/2022 and O.S.No.1824/2021 are pending between the petitioners and respondent No.2, who are none other than the family members. The dispute between the parties is essentially, predominantly and overwhelmingly of a civil nature/character in relation to immovable properties and pending before the competent civil Court.
4. It is also pertinent note that in the instant C.C.No.27904/2018, the trial has already begun and the evidence is already commenced. Under these circumstances, the question of interfering with the impugned proceedings at this stage would not arise in the facts and circumstances of the instant case and the present petition deserves to be disposed of reserving liberty in favour of the petitioners to urge all their
contentions before the trial Court.
