The petitioner was also one of the persons who had been displaced and was held entitled to the benefit of rehabilitation and resettlement benefits. The contention of the petitioner is that in case the report of respondent No.7 i.e., the Revenue Divisional Officer is accepted, it would cause loss to the 2 HCJ & RC, J W.P(PIL). No:321 of 2020 exchequer inasmuch as the beneficiaries had been shortlisted on account of extraneous considerations. It appears from the affidavit filed by the official respondents on record that after conducting an enquiry, as many as 34 persons were eligible for receiving rehabilitation and resettlement and other benefits as per Rules in force. Be that as it may, since the report now clearly establishes the right of only 34 persons to receive the benefits of rehabilitation and resettlement as against the earlier list of 51 persons, we feel that the benefits, which are otherwise required to be conferred, be accordingly conferred on those persons who have been found eligible. In that view of the matter, the proceedings are closed. No costs. Pending miscellaneous applications, if any, shall stand closed.
