2. Applicant seeks to condone delay of 1971 days caused in filing appeal. Mr. Pingale, learned advocate appearing for the applicant invites attention of this Court to the reasons as stated in Paragraph Nos. 5 and 6 of the application and submits that due to lack of knowledge as to legal proceeding and financial difficulties, applicant could not file appeal within the stipulated period. Applicant further explains that meanwhile due to COVID-19 pandemic situation, further delay has been occurred. 1 of 2 2025:BHC-AUG:11589

3. Considering the reasons as stated in the application and the fact that the applicant litigating for getting just compensation to acquired land, the aforesaid explanation can be accepted subject to certain conditions delay can be condoned.
4. In that view of the matter, I proceed to pass the following
order:
ORDER a. Civil Application is allowed. b. Delay of 1971 days caused in filing appeal is condoned subject to condition that applicant files an undertaking to the Registrar (Judicial) of this Court stating that he shall not claim interest and statutory benefits for the delayed period, in case, his appeal for enhancement of compensation is favourably considered. Undertaking to be filed within a period of eight weeks from today which shall be made part of the compilation of the appeal. c. Appeal be registered subject to removal of office objections, if any.
