The Second Appeal is preferred by the appellants against the Judgment and Decree dated 29.10.1999, passed in A.S.No.33 of 1999, on the file of the learned District Judge, Cuddapah, setting aside the Judgment and Decree dated 24.02.1999, passed in O.S.No.3 of 1997, on the file of the Principal Junior Civil Judge, Cuddapah.
2. Learned counsel appearing on both sides are present.
3. On 22.01.2025, on being represented by learned counsel for the appellants that they have no instructions, this Court ordered notice to the appellant Nos.2 to 5.
4. Today, when the matter is taken up, it is brought to the notice of this Court that notices served on appellant Nos.2 to 5. Despite service of notice, the appellants neither chose to instructions to the present counsel nor engaged another counsel to represent the matter. It seems that the appellants have no interest to prosecute the matter and this Court could not proceed further without proper representation from both sides.
5. Accordingly, the Second Appeal is dismissed for default. There shall be no order as to costs.
Interim orders granted earlier, if any, shall stand vacated.
Miscellaneous petitions pending, if any, in this appeal shall stand closed.
