Accused nos.3, 4, 6 & 7 in Crime No.70/2025 registered by Sanjay Nagar Police Station, Bengaluru City, for the offences punishable under Sections 189(4), 190, 270 of BNS, 2023, are before this Court under Section 483 of BNSS, 2023, seeking regular bail. - 3 - HC-KAR NC: 2025:KHC:18847 CRL.P No. 7490 of 2025 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.70/2025 was registered by Sanjay Nagar Police Station, Bengaluru City, for the aforesaid offences against 8 to 10 unknown persons based on the first information dated 19.04.2025 received from Mohammad Kaleem, Sub- Inspector of Police attached to Sanjay Nagar Police Station, Bengaluru City. During the course of investigation of the case, petitioners herein were arrested on 20.04.2025 and subsequently remanded to judicial custody. Bail application filed by the petitioners before the jurisdictional Sessions Court in Crl. Misc. No.3472/2025 was rejected. Therefore, they are before this Court. 4. Learned Counsel for the petitioners submits that the allegation against all the accused persons in the present case is similar. Accused no.5 has been granted regular bail by the coordinate bench of this Court in Crl.P.No.6872/2025 disposed of on 22.05.2025. Accordingly, he prays to allow the petition. - 4 - HC-KAR NC: 2025:KHC:18847 CRL.P No. 7490 of 2025 5. Per contra, learned HCGP who has opposed the petition does not dispute the submission made by the learned Counsel for the petitioners. 6. In the first information, it is stated that on 18.04.2025 at about 11.24 p.m., the first informant received a message that on the second main road at Sanjaynagar, a quarrel was taking place and immediately he went to the spot, but nobody was found at the alleged place. It is in this background, on 19.04.2025, he had verified the CCTV installed near the alleged spot of crime and found that 8 to 10 persons who were holding weapons had assembled in the alleged spot and were creating nuisance to the public. It is in this background, FIR was initially registered against 8 to 10 persons. Subsequently, the accused persons including the petitioners herein were arrested and remanded to judicial custody. Accused no.5 as against whom similar allegations are made, has been granted regular bail by the coordinate bench of this Court in Crl.P.No.6872/2025 disposed of on 22.05.2025. It is not in dispute that nobody has suffered any injury in the incident in question. The police have not received any complaint from the public about the alleged - 5 - HC-KAR NC: 2025:KHC:18847 CRL.P No. 7490 of 2025 crime. Under the circumstances, I am of the opinion that the prayer made by the petitioners for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 7. The petition is allowed. The petitioners are directed to be enlarged on bail in Crime No.70/2025 registered by Sanjay Nagar Police Station, Bengaluru City, for the offences punishable under Sections 189(4), 190, 270 of BNS, 2023, subject to the following conditions: a) Petitioners shall execute personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future; - 6 - HC-KAR NC: 2025:KHC:18847 CRL.P No. 7490 of 2025 e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off. 8.
