1. Heard Mr. J.C Gogoi, learned counsel for the petitioner. Also heard Mr. D.P Goswami, learned Addl. Public Prosecutor for the State of Assam.
2. This is an application filed u/s 483 of the BNSS, 2023 praying for grant of regular bail to the petitioner namely, Sri. Amulya Saikia who was shown arrested
Page No.# 2/2 on 27.11.2025 in connection with North Lakhimpur P.S Case No. 394/2025 u/s 118(2)/109(1) of BNS, 2023 (corresponding to G.R Case No. 1077/2025).
3. The allegation as contained in the FIR lodged by the victim Sri. Surjit Sharma (Baba) with the allegation that on 18.11.2025 at about 5:20 PM, the accused suddenly attacked her brother from behind with an intention to kill as a result of which he sustained grievous injuries and that after the incident, the accused fled away from the place of occurrence but was apprehended by the local people.
4. It is alleged that prior to the incident, the petitioner had threatened to kill her brother.
5. Case Diary, as called for, has been received.
6. I have perused the medical report which indicates injuries on the head including fracture on left mandible bone. The injury has been labeled as grievous and caused by the blunt weapon. It is submitted by learned Addl. Public Prosecutor that the victim as well as other witnesses have implicated.
7. Considering these circumstances and materials and also the fact that the investigation is in process, perhaps, it would be better to deny bail at this stage.
8. Accordingly, the bail petition stands rejected at this stage.
9. The petitions stands dismissed.
