JUSTICE PRAVEER BHATNAGAR
Order 28/08/2025
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 897/2023 registered at Police Station Kanota, District Jaipur City (East) for the offences under Sections 302 and 201 of IPC.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the petitioner along with the other co-accused caused murder of the deceased and thereafter disappeared the evidences by burning the dead body. It is also contended that the last seen evidence regarding commission of crime PW-5 Arjun Lal Bairwa, who saw the petitioner and the other co-accused has turned hostile and not supported the prosecution story. It is also
[2025:RJ-JP:34297] (2 of 3) [CRLMB-10267/2025] contended that at the instance of the petitioner, the vehicle and his blood stained clothes were recovered, however, in the FSL report, DNA did not match with the blood found in the vehicle. Similarly, the blood stains found on the petitioner's clothes also did not match with the DNA sample of the deceased. The material witnesses Munni Bai, Nisha and Kiran who deposed that the gold articles belongs to the deceased have turned hostile and not supported the prosecution story. It is also contended that co- accused Sunil Bhaat @ Kalu and Suraj Meena have already been enlarged on bail, however, the petitioner's case is on better footing than the other co-accused who have been enlarged on bail. In the FSL report, DNA of the deceased matched with the human blood found on the clothes of the other co-accused Suraj, at the instance of other co-accused Sunil, a rope was recovered having blood stains and on that rope human body traces were found. It is further contended that the petitioner is in custody since 01.10.2023, therefore, the third bail application of the accused- petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the third bail application and contended that the petitioner's first and second bail applications have been dismissed on merits. The prosecution alleges that the petitioner along with the other co- accused strangulated the deceased in the jeep owned by the petitioner. At the instance of the petitioner, gold items belonging to the deceased were recovered and human blood traces were found in the jeep and also on the clothes of the petitioner. The petitioner was in relationship with the deceased, therefore,
[2025:RJ-JP:34297] (3 of 3) [CRLMB-10267/2025] considering the gravity of the offence, the third bail application of the accused-petitioner, may be dismissed. 4. Heard and perused the material available on record. 5.
It is not desirable to express anything on the merits of the case. It is alleged against the petitioner that he resided with the deceased and thereafter, caused her murder by strangulation with a rope. It is also alleged that the deceased was taken in a jeep which is owned by the petitioner, at the instance of the petitioner, the said jeep along with his blood stained clothes and gold articles belonging to the deceased were recovered. In the jeep and clothes of the petitioner, human blood was found, therefore, considering the above facts, this Court is not inclined to enlarged the accused- petitioner on bail. 6. Hence, the third bail application of the accused-petitioner is hereby, dismissed. (PRAVEER BHATNAGAR),J Keshav/10
