2025:JHHC:20997 1 IN THE HIGH COURT OF JHARKHAND AT RANCHI Cr. Rev. No.723 of 2025 ----- Dilip Kumar Hembrom @ Dilip Kumar Hambram, s/o late Nabin Hembrom, resident of village Kitajor, PO Ladhna, PS Jamtara, District Jamtara, presenting residing in the house of late Suresh Chandra Hembrom at village Karharbel, near S.P. College, Dumka, PO Shivpahar, PS Dumka, District Dumka … Petitioner(s). Versus 1.The State of Jharkhand 2.Anjali Murmu, w/o Dilip Kumar Hembrom, D/o late Chhatan Murmu, R/o village Malwa, PO Chainpur, PS Narayanpur, District Jamtara … Opposite Party(s). CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mrs. Vani Kumari, Advocate For the Opp. Party(s) : Mr. Fahad Allam, APP …...... 05 /30.07.2025: By invoking a criminal jurisdiction of this Court, the petitioner has challenged the order dated 11.09.2024, passed in Original Maintenance Case No.83 of 2023, whereby maintenance has been fixed to the tune of Rs.3,325/- per month in favour of the wife. 2. Heard, the parties at length. 3. Learned counsel for the petitioner submits that opposite party no. 2 i.e. wife of the petitioner has herself voluntarily deserted this petitioner. She further submits that because of the attitude of opposite party no. 2, the petitioner is now jobless as he has been removed from service. She lastly submits that since the petitioner is jobless he is not in a position to maintain his wife. 4. After hearing the parties, I find that the marriage between the parties is not denied. Further, there is factual finding arrived at by the Court that the petitioner has neglected the wife. Once these two facts have been established, the petitioner is bound to pay maintenance to the wife. 5. The amount which has been fixed is Rs.3,325/- per month. In these types of cases Rs.3,325/- per month is a peanut. In these 2025:JHHC:20997 2 days, it is a bare minimum amount for maintenance. This amount cannot be said to be exorbitant. Thus, I find no illegality committed by the Court concerned, either with the quantum or in the merit of this case. 6. With the aforesaid observation, the instant criminal revision stands dismissed.
