Learned counsel for the petitioners submits that insofar as impugned order pertaining to an application filed under Order 9 Rule 9 of the Civil Procedure Code is concerned, he would be preferring an appropriate appeal in terms of Order 43 of the Civil Procedure Code in the Court of competent jurisdiction. In the appeal so filed, a challenge would also be laid to the order passed in terms of Rule 7 Order 9 of the Civil Procedure Code, in terms of Section 105 of the Civil Procedure Code.
2. In view thereof, learned counsel for the petitioners seeks permission to withdraw the present petition. Permission granted. For 1 Whether reporters of Local Papers may be allowed to see the judgment?
2 ( 2025:HHC:9536-DB ) the time spent in pursuing the present petition, the present petitioner would be entitled to the benefit of Section 14 of the Limitation Act.
3. Accordingly, present petition is dismissed as withdrawn, so also, pending miscellaneous application(s), if any.
