1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.105/2025 registered at Police Station Officer- Pulgaon, District- Durg (C.G.) under Sections 108, 3(5) of BNS, 2023 (wrongly mentioned as 108(3)(5)).

As per prosecution, in brief, is that, deceased Neha Rai committed suicide by hanging on 5.4.2025 at her house in the staff quarters of Chandulal Chandrakar Medical College, Durg, District Durg (C.G.). One suicide note was obtained upon searching her room. She has VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA
2 raised allegations upon her husband (applicant), mother in law and one Iqbal Memon alleging that they had obtained a sum of Rs. 28 lakh from the mother of the deceased. As per the averments of the suicide note it has been mentioned that the applicant has lost all the money i.e. Rs. 28 lakh in business and has wasted the entire amount. The applicant and the deceased got married in the year
2019.
3. It has been argued by learned counsel for the applicant that the applicant has been falsely implicated in this case. It is argued by
learned counsel for the applicant that the allegation levelled in the suicide note against the present applicant that he used to ask for money from the deceased and use to waste the same is false because looking to the bank statement of the deceased filed along with the charge-sheet it cannot be said that any amount has been taken by the applicant. The applicant has no previous criminal antecedents and he is in jail since 05.04.2025 and the conclusion of the trial is likely to take quite long time. Therefore, he prays for grant of regular bail to the applicant. 4. On the other hand, learned counsel appearing for the State/non- applicant would oppose the bail application and submit that applicant has no previous criminal antecedent. He further submits that applicant and the deceased got married in the year 2019 and deceased namely Neha Rai committed suicide by hanging on 05.04.2025 at her staff quarters of Chandulal Chandrakar Medical College, Durg and one suicide note was obtained upon searching her room and she has raised allegations upon her husband (applicant), mother-in-law and one Iqbal Memon alleging that they had obtained a sum of Rs.28 lakh from her savings/Fixed deposit and lost the same
3 in gambling, looking to the conduct of the applicant he is not entitled for grant of bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case and considering the fact that deceased namely Neha Rai, working as staff nurse at Chandulal Chandrakar Medical College and her husband (applicant) obtained a sum of Rs.28 lakh from deceased and her mother’s savings and lost the same in gambling, looking to the seriousness of the crime, therefore, I am not inclined to grant regular bail to the present applicant. 7. Accordingly, the first bail application of the applicant– Faiz Mohammad filed under Section 483 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.105/2025 registered at Police Station Officer- Pulgaon, District- Durg (C.G.) under Sections 108, 3(5) of BNS, 2023 (wrongly mentioned as 108(3)(5)) is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith.
