GP FOR HOME (AP) The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the respondents especially respondents No.3 and No.5 in trying to implicate the petitioner in false cases which are grave in nature and harassing the family members by calling them and visiting their house in odd hours and threatening them to hand over the 2 petitioner to them even though there are no pending crimes which are required for investigation and trying to take the petitioner into illegal custody as being illegal, arbitrary and unconstitutional being violative of Arts., 14, 19 (1) (g), 21 and 300 A of the Constitution of India, apart from various judicial pronouncements of this Honble Court as well as the Honble Apex Court and consequently direct the respondents to follow CrPC procedure if his presence is required in any crime including section 41D CrPC procedure.” 2. Sri V.Nitesh, learned counsel for the Petitioner would submit that Police are repeatedly calling the Petitioner to the Police Station without there being any case registered against him. 3. Sri V.Farooq, learned Assistant Government Pleader for Home, would submit that the Police are not calling the Petitioner to the Police Station. 4. Considering the submissions, the Writ Petition is disposed of directing the Police not to call the Petitioner to the Police Station, in the absence of any crime registered against him. There shall be no order as to costs.
