Heard Mr. NG. Somorjit, learned counsel for the petitioner and Mr. H. Debendra, learned Dy. A.G. assisted by Mr. A. Bheigya, learned counsel for the State respondent. [2]
By the present petition, the petitioner submits that she is the owner of the land under patta No. 718 (old)/239 (new) covered by C.S. Dag No. XVI/158 measuring an area of .0062 hectare of Village No. 87 (A) Khwai Bazar, Imphal West. [3]
The petitioner is aggrieved by eviction notice dated 01.09.2025 issued by Sub-Divisional Officer, Lamphel, Imphal West directing her and others to remove unauthorized structure upon Government land under Dag No. 153. [4]
It is also stated that the revenue authority has made red- marking on the buildings constructed within her patta land. [5]
On the other hand, Mr. H. Debendra, learned Dy. A.G., submits that impugned notice dated 01.09.2025 issued by the SDO, Lamphel, Imphal West is for eviction of encroachment upon Government land under Dag No. 153 of Village No. 87 (A) Khwai Bazar, Imphal West. The markings made by the revenue authority are preliminary finding and actual eviction and demolition will be conducted
after finalization of the actual encroachment by the respective owners. It is also clarified that by the impugned notice, State Government has not contemplated any eviction on the patta land. [6]
Mr. NG. Somorjit, learned counsel for the petitioner, also submits that the petitioner has submitted an objection dated 11.09.2025 to the authorities and the same is pending. [7]
On consideration of the materials on record and
submissions made at the bar, this Court is of the opinion that writ petition may be disposed of at this stage by directing the State respondent to consider the objection submitted by the petitioner and to give her ample opportunity of being heard while deciding the amount of alleged encroachment made upon the State land. [8]
Eviction, if any, upon State land shall be conducted after proper verification of the amount of encroachment. [9]
With this observation, writ petition is disposed of. [10]
The possession of the petitioner and her structure within the patta land is protected. [11]
This Court does not express any opinion on the merit of the case.
