Baran Raj. At Present Rajkiya Adarsh Higher Secondary School Dei Dist. Bundi Raj. ----Respondent For Petitioner(s) : None present For Respondent(s) : None present JUSTICE ANOOP KUMAR DHAND Order 17/01/2025
1. By way of filing this petition, a challenge has been lead to the impugned order dated 20.04.2019 passed by Additional Sessions Judge (Women Attrocities Cases) No.2, Kota in Criminal Appeal No.152/2018 by which the appeal submitted by the petitioner against the impugned order dated 07.04.2018 passed by Gram Nayaylaya has been rejected.
2. By passing the order dated 07.04.2018, the Gram Nayaylaya has partly allowed the application filled by the petitioner under Section 125 Cr.P.C. and has directed the respondent to pay maintenance amount of Rs.6000/- per month to the petitioner w.e.f. 07.04.2018.
3. Aggrieved by the aforesaid orders passed by both the courts below, the petitioner has approached this Court with a prayer for
(2 of 2) [CRLW-570/2019] issuing directions to the respondent to pay maintenance in the tune of Rs.15,000/- per month to the petitioner.
4. The sole contention of the petitioner for filing this petition is that the respondent is earning Rs.30,000/- per month and looking to the income of the respondent, the amount of Rs.6000/- is inadequate.
5. This Court has gone through the orders passed by both the courts below which indicates that on the basis of the income of the respondent, the Gram Nayaylaya has directed the respondent to pay maintenance amount of Rs.6000/- per month to the petitioner w.e.f. 07.04.2018. The aforesaid order has been passed on the basis of the evidence produced by both the sides by passing the reasoned and cogent order which requires no interference of this Court.
6. Accordingly, the criminal writ petition stands dismissed.
7. However, the petitioner would be at liberty to move appropriate application under Section 127 Cr.P.C. under the changed circumstances.
