NTPC Ltd. Vs. Baboo Ram & Ors. CMP Nos.277, 278 and 279 of 2025 IN RFA No.96 of 2013 01.03.2025 Present: Mr. Vishwender, Advocate, vice Mr. K.B. Khajuria, Advocate, for the non- applicant/appellant. Ms. Veena Sharma, Advocate, for the applicants/respondents. CMP No.277 of 2025 No reply is intended to be filed on behalf of the non-applicant. Non-applicant has no objection, if in case the legal heirs of deceased respondents No.7 and 8 are ordered to be brought on record. The appeal, in the case at hand, was decided on 06.04.2018 and no further proceedings against the judgment are pending adjudication before the Hon’ble Apex Court. From the death certificate appended along with the present application, it is evident that respondent No.7- Dharam Singh died on 20.04.2003. He is survived by legal heirs, details whereof have been given in para 3 of the application and the details so given in the application are in consonance with the Legal Heir Certificate appended along with the present application. Besides the aforesaid, respondent No.8 has died on 06.01.2005. As per his Legal Heir Certificate, he is survived by legal heirs, details whereof have been given in para 5 of the application. Right to receive compensation inheres in the legal heirs of deceased respondents No.7 and 8. In the interest of justice, legal heirs of deceased respondents No.7 and 8 are ordered to be brought on record. Amended memo of parties be filed within a week. Application stands disposed of. CMP No.278 of 2025 The appeal, in the case at hand, had been decided vide judgment dated 06.04.2018. The learned counsel for the non-applicant/appellant submits that no reply is intended to be filed on his behalf and non- applicant/appellant has no objection, if in case money, which is lying deposited in the Registry, is ordered to be released in favour of respondents No.7(i) to 7(iv), 8(i) to 8(v) and respondent No.23. In view of the aforesaid, the amount, which is lying deposited with the Registry of this Court is ordered to be released to respondents No.7(i) to 7(iv), 8(i) to 8(v)and respondent No.23 in terms of shares along with the proportionate interest thereupon, details whereof have been given in para 8 of the application, by remitting the same in their bank accounts, details whereof have been given in para 8 of the application, subject to proper verification of their identities. Application stands disposed of. CMP No.279 of 2025 The applicants-respondents are exempted from filing the true typed translation of Annexures P-2 and P-3 in question annexed with the application, at this stage, subject to filing of the same within seven days, as and when directed to do so.
