1. Heard Mr. S Dusad, learned counsel for the petitioner. Also heard Mr. D.P Goswami, learned Addl. Public Prosecutor for the State of Assam. 2. This is an application filed u/s 483 of the BNSS, 2023 praying for grant of regular bail to the petitioner namely, Mamoni Borah who has been in jail since
Page No.# 2/3 07.08.2025 in connection with Sessions Case No. 23/2025 before the Court of District and Sessions Judge, Majuli corresponding to Majuli P.S Case No. 19/2025 registered u/s 296/109(1)/118(2)/356(2) of BNS, 2023. 3. It is stated by Mr. D.P Goswami, learned Addl. Public Prosecutor that till now 3(three) P.Ws have been examined. 4. Scanned copy of the Case Record have been received. 5. Amongst the allegations, the serious part is that with a ‘heta’ during a quarrel, the petitioner caused injury on the right eye of the informant’s brother. After perusing the other documents, including the charge-sheet, it is revealed that the said victim apparently lost his right eye due to such injury. 6. The petitioner was arrested on 07.08.2025. 7. It is stated in para 7 of the bail petition that being a patient of type 2 Diabetes, she is suffering from varicose veins and there is degradation of her leg and it requires treatment failing which there may be a risk of amputation. 8. The allegations regarding the injury are quite serious leading to the loss of eyesight of the victim. Nevertheless, balancing the various facts and circumstances and also keeping in mind the submission of the prosecution that the victim has also been examined, I am of the considered view that the petitioner can be granted bail at this stage. 9. Therefore, the above named petitioner is allowed to go on bail on furnishing a bail bond of Rs. 40,000/- with 1(one) surety of the like amount to the satisfaction of the concerned Ld.
Trial Court with the conditions that : (i) The petitioner shall be available for the remaining trail. (ii) The petitioner shall not hamper or tamper the evidence. Page No.# 3/3 (iii) The petitioner shall not cause any harm or harassment to the informant, the victim or their family members. (iv) The petitioner shall not try to influence the witnesses. 10. Violation of any of the bail conditions shall entail cancellation of bail. 11. The bail petition is allowed and disposed of. JUDGE Comparing Assistant
