Heard Mr. F. Haque, learned counsel for the petitioners. Also heard Mr. R.J. Baruah, learned Addl. P.P. appearing for the State respondent.
2. This application under Section 483 of BNSS, 2023 has been filed by the accused petitioners, namely, Md. Jainuddin @ Jaymuddin and Md. Ajmol Hoque, praying for grant of bail in connection with Sualkuchi River P.S. Case No.62/2025,
registered
under
Sections 189(2)/61(2)/117(2)/118(1)/118(2)/303(2) of BNS, 2023.
3. Both the petitioners, who are stated to be father and son respectively and were arrested on 12.11.2025 in this case arising out of FIR dated 10.11.25, in which as many as 19 persons are made and the gist of the allegations that the accused persons assaulted the victims after alteration due to boundary dispute.
4. The case diary has been received.
5. Mr. R.J. Baruah, learned Addl. P.P. submits that the dispute indeed arose out of the land matters prima facie and that as per the injury report, the injuries are stated to be simple caused by blunt object. In any case petitioner no. 1 is also to be stated aged 70 years.
6. In this circumstances, both the accused persons are hereby allowed to go on bail of Rs. 25,000/- each with one surety of like amount each to the satisfaction of the learned concerned Court and subject to the following
Page No.# 3/3 conditions that:- (i) That the accused persons shall co-operate with the remaining investigation, (ii) That the accused persons shall not hamper or tamper with evidence. (iii) That the accused persons shall not misuse their liberty to commit any offences or any illegal activities,
7. Violation of any bail conditions will entail cancellation of the bail.
8. This bail application stands allowed and disposed of.
