Office is directed to register the same. This application U/S 528 BNSS has been filed to direct the Additional Civil Judge (Jr. Division)-2, Bareilly to decide Case No. 1032 of 2024 (State Vs. Shalin Mudgal and others), arising out of Case Crime No.22 of 2021, under Sections 498A, 323, 504, 506 I.P.C. and 3/4 Dowry Prohibition Act, Police Station Aonla, District Bareilly. Learned counsel for the applicant submits that the case is pending since 2022, therefore, direction may be issued by this Court to the trial court for expeditious disposal of the case. However, Mr. Rakesh Pati Tiwari, learned counsel for opposite party no.2 raises objection to the prayer made by learned counsel for the applicant and submits that applicant himself is not appearing before the court below and he is responsible for delay in expeditious disposal of the case before the trial court. This Court feels that once applicant has filed this application requesting for expediting the trial, however, he is absenting before the court below as is evident from order sheet of the trial court appended as Annexure No.3 to the application. In view of the above, the present application is misconceived and is accordingly, dismissed.
