GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 19822/2025 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…pleased to issue a Writ, order or directions, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents 2 to 5 in not initiating action on petitioners representations dated 28-01-2025, 10-02-2025 and 11-07-2025 which was made against the respondents 6 and 7 who are threatening and trying to implicate in a false cases, the 5th respondent calling the petitioner and detaining him hours together in his police station to settle the civil disputes in his police station, which is illegal, arbitrary, unconstitutional and violation of Articles 14, 16 and 21 of the Constitution of India and consequently direct the 5th respondent not to call the petitioner into Police Station and detain hours together, interfering in Civil litigation, further direct the respondents 2 to 4 to take necessary action on petitioners above representations and pass…” 2. Sri Challa Sivasankar, learned counsel for the petitioner would submit that the police are calling the petitioner to the police station and trying to implicate him in false cases and detaining him until late hours. 3. Sri V. Farooq, learned Assistant Government Pleader for Home, on instructions would submit that after receiving the representations from the petitioner, the police have conducted a preliminary enquiry and found that the core dispute in the present case arises out of private monetary transactions. Since this matter entirely pertains to personal financial transactions and falls under the category of a civil dispute, the police are not interfering in the same. 4. Recording the above said submissions, the Writ Petition is disposed of. However, the police are directed to follow the procedure according to law. As 4 no case has been registered against the petitioner, they are directed not to call the petitioner to the police station. No order as to costs.
