ORDER:- The present Writ Petition is filed questioning the order passed by the Respondents vide G.O.Rt.No.607, dated 17.07.2025 in transferring the Petitioner to the post of Assistant Director of Agriculture at Parvathipuram Manyam District in the office of the DTC/ DRC) from Assistant Director of Agriculture, Vizianagaram District.
2. The facts leading to file the Writ Petition are as follows:- The Petitioner was initially appointed as Assistant Director of Agriculture in Agriculture Department. As he had completed five years of continuous stay in Gajapathipuram, the Petitioner was in the list of candidates, who are proposed to be transferred as per G.O.Ms.No.23, dated 15.05.2025. In that view, the Petitioner had submitted a representation dated 19.07.2025 requesting for transfer to Vizianagaram by citing medical requirements of his parents, who are aged 83 and 78 years respectively.
3. Initially, vide G.O.Rt.No.443, dated 09.06.2025, the Petitioner was posted in the office of Assistant Director of Agriculture at Vizianagaram. Consequent thereto, the Petitioner joined in the transfer office. While so, the Petitioner again transferred from Assistant Director of Agriculture at Vizianagaram to the office of DTC/ DRC, Parvathipuram vide G.O.Rt.No.607, dated 17.07.2025. Hence the present Writ Petition came to be filed.
4. Learned counsel for the Petitioner would submit that the further transfer of the Petitioner is not contemplated under G.O.Ms.No.23, dated 15.05.2025 and the same is unwarranted. It is further submitted that the Petitioner has elderly parents, who require constant medical support of his contention, the Petitioner had placed on record the medical records of his parents. Therefore, the Petitioner sought for retention in the transfer office of Assistant Director of Agriculture at Vizianagaram District. attention. In
5. Learned counsel for the Petitioner would submit that pursuant to the
order of transfer, the Petitioner was transferred to office of Assistant Director of Agriculture at Parvathipuram and it would be difficult to attend to the elderly parents. It is submitted that since there is a vacant post of Assistant Director of Agriculture at the Biological Control Laboratory, Visakhapatnam, the Petitioner opted for the said place in view of medical requirements of his parents.
6. Learned Assistant Government Pleader Mr. Sarath Kumar, would submit that that the representation of the Petitioner dated 19.07.2025 would be considered on humanitarian grounds.
7. In that view, the Writ Petition is disposed of with following directions; (i) The Respondents 2 and 3 shall consider the representation of the Petitioner dated 19.07.2025 for posting as Assistant Director of Agriculture at Biological Control Laboratory, Visakhapatnam taking into
consideration of the fact that the age of the parents and their medical
requirements on humanitarian
consideration possible: as expeditiously as (li) The Respondents shall take into consideration that the Petitioner has a statutory obligation to take care of his parents under Section 4(2) of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. (iii) Pending consideration, the Respondents shall keep the post of Assistant Director of Agriculture, Biological Control Laboratory, Visakhapatnam, vacant. (iv) There shall be no order as to costs. As a sequel, miscellaneous applications pending, if any, shall stand closed.
