HON'BLE MR JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused in Crime No.212/2025 registered by Kunigal Police Station, Tumakuru District for the offences punishable under Sections 326(g) of BNS, 2023 & Section 3 of Explosive Substances Act, 1908 is before this Court under Section 483 of BNSS, 2023 seeking regular bail.
2. Heard the learned counsel appearing for the parties.
3. FIR in Crime No.212/2025 was registered by Kunigal Police Station, Tumakuru District for the aforesaid offences against the petitioner herein, on the basis of first information dated 04.05.2025 received from Sri Guruprasad K.R S/o Ramakrishnappa. During the course of investigation, the petitioner herein was arrested on 04.05.2025 and subsequently remanded to judicial custody.
4. The bail application filed by the petitioner before the jurisdiction Sessions Court in

17.05.2025. Therefore, he is before this Court.

Learned counsel appearing for the petitioner submits that the petitioner had no ill-will or motive against the first informant and the incident in question had taken place when the petitioner was in a inebriated condition. He submits that there is no loss of property nor any person has suffered any injury in the incident in question. The petitioner has cooperated with the police for the purpose of investigation. Accordingly, he prays to allow the petition.
6. Per contra, learned HCGP who has opposed the petition however does not dispute the submission made by
learned counsel for the petitioner.
7. In the first information which is submitted by Sri Guruprasad K.R. S/o Ramakrishnappa on 04.05.2025 it is stated that, he is the owner of a mobile repair shop and on 03.05.2025 at about 8.45 p.m, he had closed his shop and returned home and at about 10.00 p.m, somebody

HC-KAR NC: 2025:KHC:18675 CRL.P No. 7443 of 2025 informed him that fire was lit in front of his shop and therefore immediately he had gone near the shop and on verification of CCTV camera, he found that the petitioner was the person, who had lit fire in front of his shop and it is in this background, he had approached the police. It is not in dispute that in the incident in question that had taken place on the night of 03.05.2025 nobody has suffered any injury nor there was any property loss. Even in the first information there is no allegation against the petitioner that he had committed the alleged act with any intention or motive.
8. Learned HCGP does not dispute that the petitioner has cooperated with the police for the purpose of investigation. Undisputedly, the petitioner has no other criminal antecedents. Under these circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively

ORDER Criminal Petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.212/2025 registered by Kunigal Police Station, Tumakuru District for the offences punishable under Sections 326(g) of BNS, 2023 & Section 3 of Explosive Substances Act, 1908, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000 (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
