Heard Mr. Th. Ibohal, learned senior counsel assisted by Mr. Th. Deepak, learned counsel for the petitioner and Mr. H. Debendra, learned Dy. A.G. assisted by Ms. Sharmila, learned Jr. G.A. for the State respondent Nos. 1 to 4. None appeared on behalf of respondent No. 5 i.e. IMC in spite of service of notice. [3]
Mr. Th. Ibohal, learned senior counsel for the petitioner, submits that the petitioner is the owner of 2nd class shop site land measuring an area of .0187 hectare covered by CS Dag No. XVI/37 under Patta No. 114/131(old)/1267(new) situated at Village No. 87-A Khwai Bazar under Lamphel Sub-Division, Manipur. [4]
However, recently a notice dated 01.09.2025 has been issued by Sub-Divisional Officer, Lamphel, Imphal West for removing encroached structure upon Government land covered by CS Dag No.
25. In this regard, the petitioner submitted an objection dated 17.09.2025 stating that the structure of the petitioner is erected within her patta land and there is no encroachment upon the Government land.

If any encroachment is made, the same may be verified by proper verification and the petitioner may be given an opportunity of being heard in deciding the dispute and if any encroachment is found upon the Government CS Dag No. 25, some time may be given to the petitioner to remove any structure from the encroached portion. [6]
Mr. H. Debendra, learned Dy. A.G., submits that the impugned notice dated 01.09.2025 issued by the Sub-Divisional Officer, Lamphel, Imphal West is confined to removal of encroachers and structures upon Government CS Dag No. 25 and the State respondent does not contemplate any eviction from the patta land. [7]
This Court has considered the materials on record and
submissions made at the bar. [8]
Writ petition is disposed of at this stage by directing the respondents to decide the pending objection dated 17.09.2025 submitted by the petitioner and to give her opportunity of being heard in deciding the dispute. Any eviction or demolition from the encroached area shall be done after proper verification. [9]
It is made clear that the possession of the petitioner over her land is protected. [10]
With this observation, writ petition is disposed of. Misc. application is also disposed of. [11]
Furnish a copy of this order to the learned counsel appearing for the parties during the course of the day.
