Heard the parties. 2. This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending her arrest for offences under Sections 90, 80(2),123, 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 4. The petitioner is the married sister-in-law of the deceased. She resides in a different village. 5. The allegation in the F.I.R. is that the deceased was being tortured and dowry was demanded. It is alleged that on the fateful day, the informant got information that her daughter was assaulted and she was administered poison, as a result of which she is in a very precarious state. It is further alleged that when the informant went to see her daughter, her daughter stated that she was administered poison and she is in a bad shape. She was taken to the hospital but later on she died. 6. There is a general allegation against all the accused persons of demanding dowry, torture and assault. This petitioner is the married sister-in-law (nanad). There is an allegation that this petitioner has administered poison but surprisingly neither in the entire case diary, nor in the postmortem report or the medical report, any element of poison was found in the body. Further, the cause of death as per the postmortem report is cardiopulmonary
2025:JHHC:16422 arrest due to hemorrhagic shock. 7. Since the petitioner is the married sister-in-law residing in her in-laws' house and the allegation against her is general and since no poison was found in the body of the deceased, I am inclined to grant anticipatory bail to this petitioner. 8. Accordingly, this Anticipatory Bail Application stands allowed.
The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of her surrender or arrest, she shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand), with two sureties of the like amount each, to the satisfaction of learned J.M. 1st Class, Koderma, in connection with Satgawan P.S. Case No.49 of 2024, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property. 9.
