THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 20330 OF 2025 ORDER:
The present Writ Petition is filed aggrieved by the action of the Respondent No.1 in not considering the representation of the Petitioner dated 10.04.2025 for promotion to the post of Superintendent of Police (Non-Cadre) as illegal and arbitrary. 2. The facts leading to filing of the present Writ Petition are as follows:-
During the year 2011, a case was registered against the Officers of the Department by the ACB on the ground that bribes were being paid by the Bar and Wine Shop owners to run their businesses beyond the schedule hours. A Notice was issued to the Petitioner and others in the year 2014 by The Tribunal for Disciplinary Proceedings (in short ‘TDP’). As the enquiry was not being concluded against the Petitioner and others, W.P.No.21237 of 2021 was filed before this Court and the same was disposed of dated 05.09.2024, wherein it was held as follows:-
“11. Therefore, this Writ Petition is disposed of, while directing the respondents to conclude the enquiry initiated against the petitioner, within a period of six months from today, failing which the impugned proceedings instituted by the 3rd respondent against the petitioner vide TEC No.16/2013, dated 06.12.2013 shall stands quashed”. 3. It is the contention of the learned counsel for the Petitioner that despite a specific direction by this Court to conclude the enquiry within six months, there has been no progress in the matter since then.
In view of non
compliance of the Order of this Court, the Proceedings dated 06.12.2013 issued against the Petitioner shall deem to be quashed. It was in that context, the Petitioner had submitted a representation dated 10.04.2025 to consider his case for promotion to the post of Superintendent of Police (Non-Cadre), but same could be considered by the Respondents. 4. Learned Assistant Government Pleader for the Respondents would submit that the Respondents are seeking extension of time as fixed by this Court in W.P.No.21237 of 2021 and as regards the representation of the Petitioner, a decision would be arrived at the earliest. 5. In that view, the Writ Petition is disposed of, directing the Respondents to consider the representation of the Petitioner dated 10.04.2025 for promotion to the post of Superintendent of Police (Non-Cadre) as expeditiously as possible, preferably, within a period of two (02) months from the date of receipt of a copy of this order, by taking into consideration the default clause in the orders passed by this Court in W.P.No.21237 of 2021, dated 05.09.2024.
