Also heard Mr B Sarma, learned Additional Public Prosecutor for the State of Assam. 2. This interlocutory application has been filed in Bail Application No. Page No.# 2/2 2345/2018, praying for modification of the third condition leveled on the petitioner to the extent that it restricts the applicant from leaving the territorial limits of the city of Guwahati without prior written permission of the learned Special Judge, Assam, and without prior intimation to the investigating agency. 3. The learned counsel for the applicant has submitted that the investigation is already over and the trial is now proceeding. He has submitted that since the applicant has now joined a profession, which requires him to move outside Guwahati, this Court may consider modification of the aforesaid condition. 4. We have heard the learned Additional Public Prosecutor, who has submitted that the trial is going on and, therefore, the permission of the investigating authority would not be required at this stage. Accordingly the aforesaid condition No. (iii) of the order dated 10.10.2018, passed in Bail Application No. 2345/2018, is modified to the extent that the condition requiring the applicant to take permission to leave the jurisdiction and territory of the learned Special Judge, Assam, or the investigating agency, is recalled. 5.
