Laskar, learned counsel for the petitioners. Also heard Mr. B. Kaushik, learned standing counsel, Education (Elementary) Department, appearing for the respondent Nos.1 and 2 and Ms. B. Bhuyan, learned Senior counsel cum standing counsel, BTC, assisted by Ms. B. Bora, learned counsel for the respondent Nos.3—5. 2. In this petition under Article 226 of the Constitution of India, the petitioners have prayed directing the respondent authorities, more particularly, the respondent Nos.1 and 2 to provincialize the services of the petitioners as Hindi Language Teachers in their respective schools in accordance with the provisions of Section 3(1)(xi) of the Assam Education (Provincialization of Services of Teachers & Re-organization of Educational Page No.# 15/17 Institutions) Act, 2017. 3. Mr. Laskar, learned counsel for the petitioners submits that the petitioners were appointed as Hindi (Language) Teachers in various Upper-Primary (M.E.) Schools, which were established as venture schools in Baksa district of Assam. They have been serving continuously for more than 20 years and some of the petitioners are at the verge of retirement. They have been working without any fixed pay, only with the hope that their services would be provincialized in due course, as per law, by the State respondents in due recognition of their services rendered by them without remuneration. 4. Mr. Laskar further submits that the petitioners possessed the required qualification and they are also entitled to get the benefit of provincialization and that Hindi language is a compulsory subject, which is being taught in all Upper-Primary (M.E.) Schools in the State of Assam. Mr. Laskar further submits that the schools of the petitioners along with the teaching staff have been provincialized under the Assam Education (Provincialization of Services of Teachers & Re-organization of Educational Institutions) Act, 2017, but the petitioners have been left out and being aggrieved, the petitioners approached this Court by filing the present petition. 5. Mr. Laskar further submits that similarly situated petitioners have filed several writ petitions before this Court, being WP(C) No.5072/2021 (Monowara Khatun & 8 Ors. v. State of Assam & 3 ors.) and batch, WP(C) No.3477/2025 (Balen Engti & 60 Ors. v. State of Assam & 4 Ors.) and WP(C) No.2067/2025 (Md. Anowarul Islam & 11 Ors. v. State of Assam & 5 Ors.), wherein directions were issued to the petitioners to file individual representation before the appropriate authority for provincialization of their services within a period of 20(twenty) days from the date of passing of the order and it was also directed that on such representation being filed by the petitioners, the respondent authorities shall consider the individual case of the petitioners within a period of 4(four) months and since the present petitioners are also similarly situated with the petitioners of those petitions, the present petition may also be disposed of granting similar reliefs. 6. Ms. Bhuyan, learned Senior counsel cum standing counsel, BTC, for the respondent Page No.# 16/17 Nos.3—5 and Mr. Kaushik, learned standing counsel, Education (Elementary) Department, for the respondent Nos.1 and 2 submits that they have no objection if the present petition is disposed of by granting similar relief to the writ petitioners of WP(C) Nos.5072/2021, 3477/2025 and 2067/2025. Notably, the said petitions were disposed of granting similar relief like the petitioners in WP(C) No.3597/2021 (Alokesh Chandra Ray & Ors. v. State of Assam & Ors.). 7. Having heard the submission of learned counsel for both the parties, I have carefully gone through the petition and the documents placed on record and also perused the orders passed in WP(C) Nos.5072/2021, 3477/2025, 2067/2025 and 3597/2021. 8. The basic facts here in this case are not in dispute. The petitioners are serving as Hindi Teachers for last 20 years without getting any benefit and it is also not in dispute that some of the petitioners are at the verge of retirement. But, their services were yet to be provincialized by the respondent authorities. 9. It is to be noted here that some similarly situated teachers have filed one writ petition, being WP(C) No.3597/2021, which was disposed of vide order dated 17.03.2025, with the following directions:- “22. The petitioners are directed to file their individual representation before the appropriate authority within a period of 20(twenty) days from today. On receipt of the representation that may be filed by the petitioners as directed herein above, the respondent authorities shall consider the case of the petitioners individually within a period of 4(four) months thereafter.” 10. This decision appears to be squarely applicable in case of the present petitioners. Accordingly, taking note of the aforementioned direction and also taking note of the submission of learned counsel for both the parties and as agreed upon, this Court is inclined to dispose of this petition by directing the petitioners to file individual representation before the respondent authorities within a period of 3(three) weeks from today and on such representations being filed by the petitioners, the respondent authorities shall consider the individual case of the petitioners within a period of 4(four) Page No.# 17/17 months from the date of receipt of certified copy of this order. 11. The petitioners shall obtain a certified copy of this order and enclose the same with the representation to be filed by them individually before the respondent authorities.
