JUSTICE RAJESH MAZUMDAR ORDER 19.12.2025 Heard Mr. B Chowdhury, learned counsel for the petitioner. Also heard Mr. D P Goswami, learned Additional Public Prosecutor, Assam for the State. Page No.# 2/3 This is an application under Section 483 of the BNSS, 2023 for granting regular bail to the petitioner in connection with Nagarbera Police Station Case No. 92/2025 corresponding to G.R. No. 431(K)/2025. The gist of the FIR is that the police had intercepted a vehicle carrying five numbers of cattle for which the owner cum driver of the vehicle could not produce the necessary challan. The present application has been filed by the owner cum driver of the vehicle, who was taken into custody on 05.12.2025. The petitioner has annexed the receipts of the cattle, which he stated to have obtained from the owner of the cattle. This Court is of the opinion that the continued custody of the petitioner is not required for further investigation of the case. In such view of the matter, the petitioner is directed to be released on bail in connection with the aforementioned case on furnishing a bail bond of Rs. 15,000/-, with two sureties of the like amount, to the satisfaction of the learned Judicial Magistrate First Class, Boko, Kamrup, Assam, subject to the following conditions – (i) That the petitioner shall co-operate with the investigation and appear before the I/O for further examination. (ii) That the petitioner shall not hamper or tamper with the evidence. (iii) That the petitioner shall not involve himself in similar activities.
