Heard Mr. H.R. Choudhury, learned counsel for the accused petitioners as well as Mr. P. Borthakur, learned Addl. P.P. appearing for the State respondents and Mr. S. Das, learned counsel for the respondent no.2. 2. This application under Section 483 of BNSS, 2023 has been filed by the petitioner, namely, Raj Uddin @ Moharaj Hussain, seeking regular bail in connection with Special Sessions (POCSO) Case No.260/2023 arising out of Karimganj P.S. Case No.894/2023 proceeded under Sections 120(B)/366(A)/376(3)/417/34 IPC R/W Section 4/6/8 of Protection of Children From Sexual Offences Act, 2012 (POCSO) pending before the learned Addl. Sessions Judge, FTC, Sribhumi. The accused person is stated to be arrested on
30.07.2025. 3. The scanned TCR has been received. 4. The case is poised for commencement of trial but the same has not yet commenced. The statement of the victim girl was recorded before the learned JMFC is available and I perused the same in which her age is indicated as 17 years and though she has stated about the accused having physical relationship with her forcefully but she is also stated about her love affair with him. 5. Under the given facts and circumstances and considering the length of detention and completion of investigation, the accused petitioner is hereby
Page No.# 3/3 allowed to go on bail of Rs. 40,000/- with one surety of like amount, to the satisfaction of the concerned learned Addl. Sessions Judge, FTC, Sribhumi and subject to the following conditions that:- (i) He will co-operate with the trial, (ii) He shall not hamper or tamper with the evidence. (iii) He shall not in any manner intimate or harass or harm the victim/informant and their family members. 6. Violation of bail conditions will entail cancellation of the bail. 7.
