This is an application under Section 482 of the BNSS, 2023 praying Page No.# 2/3 for grant of pre-arrest bail to the accused/petitioner, viz., Sri Hiranya Deka in connection with Dispur P.S. Case No.819/2025 registered under Section 69 of the BNS, 2023. The allegation against the petitioner is that he entered in a physical relationship with the alleged victim who is a major with the promise of marriage. It appears that the accused/petitioner was granted interim pre- arrest bail by this Court on 27.10.2025 and the Case Diary was called for. The Case Diary as called for has been received. I have perused the same. The learned Addl. P.P. with reference to the materials available in the Case Diary submits that the victim has implicated the petitioner. It appears from the statement of the accused himself that he concealed the fact that he was a married person and therefore, it prima-facie appears that the petitioner induced the victim to enter into physical relation with him by practicing deception. Considering the above, this Court is of the opinion that the present not a fit case for grant of pre-arrest bail. Accordingly, the prayer for pre- arrest bail stands rejected. The order of interim pre-arrest bail dated 27.10.2025 hereby stands vacated. Page No.# 3/3 Return the Case Diary. The Anticipatory Bail Application stands disposed of. JUDGE Comparing Assistant
